Deposit Protection

Authorised schemes

For tenancies* in England and Wales that started after 6 April 2007, Landlords are legally required to place your tenancy deposit into one of the authorised schemes:-

   1. MyDeposits

   2. Tenancy Deposit Scheme

   3. Deposit Protection Service

If you deposit is not duly protected within 30 days of your Landlord receiving it, you are entitled to claim statutory compensation (1 to 3 times of your deposit). Please visit here for further information of how we can protect your tenant's rights.

*This requirement applies to Assured Shorthold Tenancies.

Custodial vs Insured

Two types

There are two types of schemes, depending on the authorised scheme provider, timelines and procedures may vary.

   - Custodial: This is where the Scheme holds the deposit for the duration of

     the tenancy.

   - Insured: This is where the Landlord/Managing Agent can hold the deposit

     during the terms of the tenancy. In cases of disputes, the landlord will be

     required to pay the Scheme the disputed amount before the decision is

     made. 

Deposit Cap

How to calculate your maximum deposit

From 1 June 2009, the following maximum limits are imposed:-

   1. Security Deposit: 

      - if your annual rent is less than £50,000: 5 week's rent.

      - if your annual rent is £50,000 or more: 6 week's rent.

   2. Holding Deposit: 1 week's rent

   3. Default fees: limited to reasonable costs 

      - if you have rent arrears (14 days of more): interest is capped at 3% above

        BoE base rate
